1. Overview

Electric Harbour Tours Inc. (“Electric Harbour Tours”) is committed to protecting your privacy.  Electric Harbour Tours collects, uses, and discloses your personal information in accordance with privacy laws and any other applicable legislation.

The purpose of this privacy statement is to inform you of the personal information that we may collect from you when visiting or using the Electric Harbour Tours website located at https://electricharbourtours.com/ (the “Site”), and how that information may be used and disclosed.  Electric Harbour Tours also collects other types of information, including employee personal information, the terms and conditions of which are covered by another Privacy Policy. The Electric Harbour Tours Privacy Policy is available through our Privacy Officer.

This privacy statement relates to the information collected from you as a result of your visit to the Site. This statement supplements Electric Harbour Tours’s other privacy procedures and practices. By visiting and continuing to use the Site, you acknowledge the notices in this policy and consent to our collection, use, and disclosure of your personal information in accordance with this policy.

3. Collection of your personal information

A. Personal information you provide

Electric Harbour Tours will collect personal information through the Site when you voluntarily provide it. Examples include when you complete the “Contact Us” form on the Site or place an order. We collect the personal information to provide you with the information or service that you have requested.

During your use of the Site, you may be asked to provide personal information such as your name, e-mail address, mailing address, telephone number, account login, credit card information, and password information. At that time, you may choose not to provide certain requested personal information, but this may affect your ability to use certain services provided by Electric Harbour Tours or access or use certain sections of the Site.

Electric Harbour Tours may collect your personal information for the following purposes:

  • to contact and correspond with you regarding the Site, and services offered by Electric Harbour Tours including special events;
  • to process payments by or to you;
  • to respond to specific requests from you;
  • to otherwise administer your relationship with Electric Harbour Tours, including contacting you about your orders or order-related matters;
  • to process suggestions and comments provided by you;
  • to improve the Site services;
  • to administer the Site and to protect the security of the Site when necessary; and
  • to facilitate such other services and activities as we may identify at the time.

We will also collect and use your personal information to establish and maintain your online account, which is accessible through the secure portal on the Electric Harbour Tours website. Registered users will have the ability to view, update, and change their personal profile. Users are responsible for ensuring verification information, including account usernames and passwords, are protected and that you do not disclose them to other individuals.

B. Automatically Gathered Personal Information

(a) Website Visits

Electric Harbour Tours’s website server automatically collects the following non-personally identifiable information from visitors to the website:

  • the web browser and operating system you are using;
  • the date and time of the visit;
  • the sections of the Site you visit, as well as the pages read and the images viewed;
  • certain content that you download from the Site;
  • if you were on another website before visiting the Site, the URL (web address) of that previous website, if it referred you to the Site;
  • the URL of the first website you visit immediately upon leaving the Site, if you were referred to that website by the Site;
  • the Internet Protocol (IP) address of the computer you are using; and
  • the IP address of your Internet Service Provider.

We do not link any of the above information with information that is personally identifiable to you. We collect this data in an aggregate format for a number of reasons, including to understand the traffic on our website, how it is used, and how we can improve it. For example, the information about our visitors' browsers tells us what kind of browsers we need to support. Other information lets us know how many visitors come to our site and what sections are the most popular. We do not share this aggregate data with third parties.

(b) Cookies

The Site uses “cookies”. Cookies enable our website to save and retrieve information that you enter. A cookie is a commonly used piece of software that tracks your website visits and preferences, and is capable of enhancing your visit to the site. It may remain on your computer after the Internet session finishes (until the cookie expires or is deleted by you).

If you do not want to accept cookies, you can disable them by adjusting the settings on your internet browser. Your decision to disable cookies may impair your ability to browse, read, and download information contained on the Site, and Electric Harbour Tours may be unable to personalize your web experience. However, you may still be able to access Electric Harbour Tours services by other methods such as personal contact, fax, telephone, or mail.

(c) Web Analytics

The Site uses web analytics tools to help analyze how the Site is used and to improve visitors’ online experience. These tools work by tagging web pages to capture a limited amount of data (including the IP address of the computer, device, or network being used to access the pages). This data is used for aggregate reporting purposes. None of this data is used by Electric Harbour Tours or its service providers to identify you.

The Site also uses remarketing tools, such as Google’s AdWords remarketing (“AdWords”). Adwords connects the activity of Electric Harbour Tours with the Adwords advertising network and the Double click Cookie. Electric Harbour Tours displays interest-based advertising on third-party websites using information you make available to us when you interact with our website, content, or services. If you do not wish to receive this type of advertising from us in the future you can opt out using the DoubleClick opt-out page or the Network Advertising Initiative opt-out page.

4. Use of your personal information

Personal information will only be used to fulfill the purpose for which it was originally collected, or for a use consistent with that purpose, unless you expressly consent otherwise.

Generally, the information we use relates directly to the provision of sightseeing services and the purpose for which you have provided it to Electric Harbour Tours. We use information from the Site to respond to specific requests from you, to process suggestions and comments provided by you, to otherwise administer your relationship with Electric Harbour Tours (including contacting you about tours or other matters), and to facilitate such other services and activities as we may identify at the time.  Electric Harbour Tours also collects information about its Site and the information and services on it to better understand general user trends at an aggregate level, to promote and improve its services, and to assess web performance, web services, and for website maintenance.  Electric Harbour Tours may also use information it collects for the purposes of an investigation into a breach of the terms of use of the Site, or other legal requirement.

5. Marketing Communications

Electric Harbour Tours may contact you in different ways. It may contact you to inform you about products or services by mail, e-mail, telephone, or other means to which you have agreed.

With your express consent, Electric Harbour Tours may also use the personal information you provide to send you information about special offers and promotions, news releases, information which may be of interest to you, or other electronic communications. In order to do this, your information may be shared with a third party, for example, a marketing and communications company. These electronic communications will provide you with our contact information and a method to opt-out of receiving further communications from us with each e-mail or other electronic communication we send you. You may withdraw your consent at any time.

6. Disclosure of your personal information

With the exception of our third party service providers, Electric Harbour Tours will only share your personal information outside Electric Harbour Tours with your consent, or where we use it to provide you with products and services you request. For example, when it is required to provide you with the information or services you have requested, in which case we will consider you to have given implied consent (e.g., confirmation of a sightseeing tour). The third party service providers will have access to personal information needed to perform their functions, but are only provided the limited amount of information required to perform their services.

Electric Harbour Tours uses third party service providers for the purpose of sending out certain electronic communications. Currently, these providers include Zaui Software and Infusionsoft. In using these services, Electric Harbour Tours will provide these service providers with personal information such as your name and e-mail address.

Infusionsoft is a service located outside of Canada, which means that your personal information may be subject to being stored and accessed pursuant to the laws of the United States of America. If you have any questions about Electric Harbour Tours’s policies and practices with respect to service providers outside of Canada, including their collection, use, disclosure, and storage of personal information, you can contact the Electric Harbour Tours Privacy Officer at the contact information listed at the end of this statement.

When Electric Harbour Tours uses third party service providers, it requires the providers to protect your personal information in accordance with the law and with the same or more stringent security and privacy standards than Electric Harbour Tours. Any such disclosure of your personal information by Electric Harbour Tours to a third party service provider will be conditional upon the information being used solely for the purpose for which it has been disclosed.

Electric Harbour Tours may also disclose your personal information where authorized or required by law. For example, we may disclose your personal information to comply with a subpoena, in response to a law enforcement body with the lawful authority to obtain the information, pursuant to an investigation into the breach of a law, or to our legal counsel.

6. Protection of your personal information

Electric Harbour Tours takes reasonable steps to protect your personal information. We use security arrangements to protect against unauthorized access, collection, use, disclosure, and disposal. These security measures include the following:

  • restricting access to our systems, applications, and collected data to authorized personnel only;
  • use of firewalls; and
  • training of staff on privacy and confidentiality practices.

The Site may include links to external websites. Once you leave the Site, this privacy statement does not apply. Electric Harbour Tours is not responsible for the privacy practices, collection of personal information, or content of external websites.

7. Retention of your personal information

Information collected by Electric Harbour Tours is maintained in accordance with federal and provincial privacy legislation and Electric Harbour Tours’s retention schedules.

8. Changes to the privacy statement

Electric Harbour Tours may occasionally update this policy statement from time to time by posting a new version of this statement on the Site. Electric Harbour Tours’s collection, use, disclosure, and retention of your personal information will be governed by the version of this policy statement in effect at that time. We suggest that you review this statement periodically.

It is your responsibility to provide any updates to your personal information to Electric Harbour Tours. You may request access to your personal information and/or correction of that information by contacting Electric Harbour Tours at the contact information noted below.
